TERMS AND CONDITIONS OF SALE AND USE

Welcome to Alcyon Sel de Mer. Before browsing our site or placing an order, please take a moment to read these terms. They simply describe what you can expect from us, and what we expect from you. By using alcyonsel.com or purchasing any of our products, you agree to these terms.

1. About Alcyon

Alcyon Sel de Mer Inc. is a family-owned business incorporated in Quebec, with its head office at 27 chemin des Buttes, Havre-aux-Maisons, Quebec G4T 5L4. Our sea salts are harvested in the Îles de la Madeleine, and some of our products are made in Montreal. Our website is hosted by Shopify Inc.

In these terms, "we", "our" and "Alcyon" refer to Alcyon Sel de Mer Inc. "You" refers to the person visiting our site or placing an order.

2. Who can order from us

To place an order, you must be of the age of majority in your province of residence (18 in Quebec) or have your legal guardian's consent. By placing an order, you confirm that the information provided is accurate and that you are the person authorized to use the chosen payment method.

3. Our products

We put a lot of care into presenting our products accurately, in pictures and in words. Please note, however, that colours may vary slightly depending on your screen, and sea salt crystals are by nature unique from one batch to another. That's part of their character.

Some items are produced in limited quantities and may temporarily be out of stock. We reserve the right to limit quantities sold per person, to remove a product from our catalogue, or to adjust prices without notice. The price that applies to your order is the one displayed at the time you complete your purchase.

4. Placing an order

Orders are placed directly on alcyonsel.com. When you click "Pay now", you accept these Terms and Conditions as well as our Shipping Policy, Return Policy, and Privacy Policy. A confirmation email with your order details will be sent within minutes. If it doesn't show up, check your spam folder before writing to us.

We reserve the right to refuse or cancel any order that appears fraudulent, manifestly erroneous (an obvious pricing error, for example), or contrary to these terms. If we cancel your order, you'll be fully refunded.

5. Payment

Payments are made online only, on alcyonsel.com, through the methods offered at checkout (major credit cards, Shop Pay, Apple Pay, Google Pay, etc.). Transactions are securely processed by Shopify Payments. We never have access to your full banking information.

For everyone's safety, we do not accept payment by phone, by email, or by Interac e-Transfer. No one on our team will ever ask you to share your credit card details by message or by phone. If someone claiming to be Alcyon asks for this kind of information, do not share it and write to us at info@alcyonsel.com.

Prices are listed in Canadian dollars, before tax. Quebec taxes (GST and QST) are calculated and added at checkout, regardless of the province of delivery.

6. Shipping and delivery

Shipping terms (fees, delays, in-store pickup, lost or damaged parcels) are detailed in our Shipping Policy. It forms an integral part of these terms.

7. Returns, exchanges, and refunds

All sales are final, except in the case of a damaged product, breakage during delivery, or an error on our part. Full details are explained in our Return Policy, which forms an integral part of these terms.

8. Legal warranty

As a Quebec consumer, you benefit from the legal warranty provided by the Civil Code of Quebec and the Consumer Protection Act. This warranty applies to our products and is not affected by these terms. For more information, visit the Office de la protection du consommateur (opc.gouv.qc.ca).

9. Gift cards

Alcyon gift cards are valid only for online purchases at alcyonsel.com. They have no expiry date, cannot be exchanged for cash, and are non-refundable, except where required by law. We cannot replace lost or stolen gift cards, so please keep them in a safe place.

10. Subscriptions

If you activate a subscription, the specific terms (frequencies, modifications, cancellation, automatic payment) are described in our Subscription FAQ. By activating a subscription, you authorize Alcyon to make recurring charges to your payment method based on the chosen frequency. You can modify, pause, or cancel your subscription at any time from your customer account, free of charge.

11. Personal information

We take the protection of your personal information seriously. How we collect, use, and store it is explained in our Privacy Policy.

12. Intellectual property

All content on alcyonsel.com (texts, photos, videos, illustrations, logos, marks, design) is the property of Alcyon Sel de Mer Inc. or used with permission. Content may be viewed, shared, and printed for personal use, but any commercial reproduction, modification, or use without our prior written consent is prohibited.

Comments, photos, suggestions, or ideas sent to us by email, form, or social media may be used by Alcyon without compensation, with or without mention of the author's name, at our discretion. This does not apply to personal information, which remains protected by our Privacy Policy.

13. Expected conduct

When using our site, you agree not to use it for unlawful purposes, not to attempt to access systems through unauthorized means, not to post offensive or defamatory content, and not to seek to collect personal information from other users. We reserve the right to suspend access to the site for anyone who fails to comply with these rules.

14. Links to other websites

Our site may contain links to third-party websites (media, partners, retailers). We have no control over their content and are not responsible for what is found there or what may happen there. Before trusting them, take the time to read their own terms and policies.

15. Limitation of liability

We do everything we can to provide a quality shopping experience. That said, to the extent permitted by law, our liability is limited to the amount you paid for the order in question. We cannot be held responsible for indirect losses (loss of profit, loss of data, etc.) resulting from the use of the site or our products.

This clause does not limit your rights as a Quebec consumer under the Consumer Protection Act, nor the legal warranty that applies to our products.

16. Modifications

We may update these terms from time to time, to reflect changes in our practices, in our products, or in the law. The version in effect is always the one posted on this page, with the update date at the top. For orders already placed, the terms in effect at the time of the order apply.

17. Governing law and dispute resolution

These terms are governed by the laws of Quebec and the federal laws of Canada that apply. In the event of a dispute, we invite you to first write to us at info@alcyonsel.com so we can try to find a solution together. If that's not possible, the courts of the judicial district of the Îles de la Madeleine or Montreal have jurisdiction, except as otherwise provided by the Consumer Protection Act.
